1. Purpose

These Terms of Service (hereinafter "Terms") govern access to and use of the services offered by Flowrigin (hereinafter "the Services"). By accessing our website and using our Services, you unconditionally accept these Terms.

Flowrigin offers generative artificial intelligence solutions for businesses, including:

• Artificial intelligence consulting and strategy
• Development of custom AI agents
• Integration of AI solutions into existing systems
• Training and support for teams
• Support and maintenance of deployed solutions

3. Service Access

3.1 Access conditions

Access to the Services requires an Internet connection and compatible equipment. You are responsible for providing and maintaining your equipment and Internet connection.

3.2 Registration

Some Services may require creating a user account. You agree to:

• Maintain the confidentiality of your login credentials

All elements of the Services (texts, graphics, software, photographs, images, videos, sounds, plans, names, logos, trademarks, etc.) are the exclusive property of Flowrigin or its partners. Any unauthorized reproduction, representation, modification, or exploitation is prohibited.

5.2 User content

You retain all rights to the content you submit to the Services. By submitting content, you grant Flowrigin a worldwide, non-exclusive license to use, process, and analyze this content as part of providing the Services.

5.3 Custom developments

Intellectual property rights on specific developments made under a service contract are defined in specific contractual agreements.

The collection and processing of your personal data are governed by our Privacy Policy, which is an integral part of these Terms.

7. Liability

7.1 Service availability

Flowrigin strives to ensure the availability of Services 24/7. However, we reserve the right to temporarily interrupt access for maintenance, updates, or any other technical reason. Flowrigin cannot be held responsible for service interruptions.

7.2 Limitation of liability

To the extent permitted by law, Flowrigin cannot be held liable for:

• Indirect damages resulting from the use or inability to use the Services
• Loss of data, profits, revenue, or expected savings
• Content generated by artificial intelligence and its use
• Decisions made based on results provided by the Services

7.3 Use of AI results

Results generated by our AI solutions are provided for informational purposes. You are solely responsible for verifying and validating results before any professional use or decision-making.

8. Pricing and Payment

8.1 Prices

Service rates are indicated in euros excluding taxes. Flowrigin reserves the right to modify its rates at any time, subject to reasonable notice for subscription services.

8.2 Payment terms

Payment is made according to the terms defined in the quote or service contract. Invoices are payable upon receipt, unless otherwise stated. In case of late payment, penalties may be applied in accordance with the law.

9. Duration and Termination

9.1 Duration

These Terms apply for the entire duration of use of the Services. Specific contracts define their own commitment period.

9.2 Termination

Flowrigin reserves the right to suspend or terminate your access to the Services in case of:

• Violation of these Terms
• Non-payment of amounts due
• Fraudulent or abusive use of the Services
• Behavior harmful to other users or Flowrigin

9.3 Consequences of termination

In case of termination, your access to the Services will be immediately interrupted. Amounts already paid will not be refunded, except by legal provision.

10. Modifications to Terms

Flowrigin reserves the right to modify these Terms at any time. Modifications take effect upon publication on the site. Your continued use of the Services after publication of modifications constitutes acceptance of the new Terms.

11. Applicable Law and Jurisdiction

These Terms are governed by Estonian law (Võlaõigusseadus - Law of Obligations). In case of dispute, and failing amicable resolution, Estonian courts will have sole jurisdiction.

12. Miscellaneous

12.1 Entire agreement

These Terms constitute the entire agreement between you and Flowrigin regarding the use of the Services, except for specific signed contracts.

12.2 Severability

If a provision of these Terms is declared invalid, the other provisions will remain in force.

12.3 Waiver

Flowrigin's failure to exercise a right provided by these Terms does not constitute a waiver of that right.
